James F Rogers Jr



On August 26, 2006, James F. Rogers Jr., 18, of North Jackson, Tennessee was killed by illegal alien Luis Oscar Garcia, 24, in Jackson, Tennessee.

According to a police report, Garcia's 1995 Chevy S-10 pickup ran a red light while traveling north on the U.S. 45 Bypass at Oil Well Road about 2 a.m. Saturday. He slammed into the '95 Honda Civic that Rogers was driving westbound on Oil Well.

Police said Garcia had a strong odor of alcohol on his person and that his pants were soaked with a liquid that indicated the presence of alcohol. There also were two beer bottles, one partially filled, in the truck at the time of the accident, police said.

In addition to the vehicular homicide and DUI charges, Garcia faces counts of driving without a license, registration or proof of insurance. When police did a check on his license plate, it did not come back under his name, the report said.

Garcia was charged with vehicular homicide, DUI, and driving without a license, registration or proof of insurance.

Garcia, a Mexican national, admitted he had been living in the U.S. without a green card for three years. He was ordered held without bail.

A preliminary hearing is set for Sept. 7, and it is likely Garcia, who speaks little English, will use a court-appointed attorney for his defense.

The U.S. Department of Immigration and Customs Enforcement also has placed an administrative hold (retainer) on Garcia, that will prevent him from bonding out of jail, according to court records.

Temple Black, Immigration and Customs Enforcement spokesman, said that Garcia is in the United States illegally and that as soon as court proceedings are over and he has served his time, he will be sent back to Mexico. "If he is found guilty on those charges, he has to serve his term in that jurisdiction," Black said. "When he finishes that term, he will be bound over to the Department of Immigration and Enforcement and deported."

While racing with another driver on Route 3 in Boone County, West Virginia, Christian Javier Sanchez-Rubio, an inebriated illegal alien, murdered little Tyler Lee Evans. The truck driven by Tyler’s dad was hit head-on by Sanchez-Rubio as he sped down the wrong side of the road.(1) 

Five year old Tyler’s unjustifiable death occurred on August 31, 2006. Terry Evans and his other son, two year old Micah, survived the accident with injuries and were taken along with Tyler to a Charleston hospital.  Micah required surgery. (2) 

Marsha and Terry Evans created a memorial filled with expressions of love for their little boy, Tyler.

The writings are heartbreaking, steeped in the Evans’ grief for their lost son. (3)

 "…for me and Terry and Micah a wonderful and amazing gift of love and beauty was taken on the night of August the 31st 2006. Today I pray for justice for my son and I also pray for the daily strength to deal with the loss of such an amazing boy. Upon arrest Sanchez-Rubio was carrying two sets of false documents, a fake immigration document and a Mexican driver’s license both under the name of Jose Carlos Madrigal. He was charged with a felony count of DUI causing death and sentenced to 10 years in the WV state penitentiary with eligibility for parole. (1)

On October 27, 2006 Meghan Hughes, 22, Ben Leonard, 16, and Jennifer Carter, 18 were all killed by drunk driving illegal alien Pastor Rios Sanchez.

State Troopers say, Pastor Sanchez was drunk when he crossed the center line of the highway and plowed into them head on. Hughes, of Summerville, S.C., Carter, of Jacksonville, both students at North Carolina State University, and Hughes' stepbrother, Leonard, were returning to Raleigh from Lee County when a 1999 Dodge Intrepid driven by Rios crossed the center line on N.C. Highway 42 about five miles east of Sanford, authorities said.

The Intrepid collided head-on with Hughes' 1990 Toyota Corolla station wagon, killing Hughes and Carter instantly. Leonard died during surgery at Central Carolina Hospital, authorities said

Sanchez broke his arm in the accident.

ABC11 news reported, “Investigators say the driver of the car that hit the students should never have been behind the wheel.” Additionally, Sanchez was convicted of driving without an operators license in 2005, according to court records. He was charged with a similar misdemeanor in March and April. One of the charges was dismissed, but Sanchez failed to appear in Harnett County court in August, records show.

Though Sanchez had a residency card, investigators now believe it was a fake, said Tom O'Connell, the resident agent in charge for Immigration and Customs Enforcement.

O'Connell said Sanchez was from the Mexican state of Guerrero, and that immigration officials don't believe he has ever legally been in the United States.

In November 2006, federal immigration agents confirmed that Rios is in the country illegally and placed him under an immigration detainer, meaning that if he's going to be released from custody for any reason, he'll be turned over to federal authorities, who can begin the process of deporting him.

Zach Spinks the victims' friend states, "I know the 3 of them. They were strong Christians. They had good faith. I know they're in heaven right now just praising god." The 3 were members of Grace Community Church which meets on N.C. State's campus for bible study and other events.

Another friend, Logan Hux, stated, "It's caused a lot of damage to us, our church family."

Pastor Rios Sanchez was offered a chance to plead guilty to a reduced set of charges. The news had Dannon Forbes of Columbia, S.C., fuming.. Forbes is the mother of 16¬year-old Ben Leonard and 22¬year-old Megan Hughes,. Forbes said she was contacted this week by an attorney handling her children's estates and told that Lee County Assistant District Attorney Mike Beam plans to offer Rios a chance to plead guilty to three counts of involuntary manslaughter and face 16 to 20months in prison for each count.

Forbes said she hopes the presiding judge will reject the plea deal. "All I know is that I have to keep fighting this," she said. "The D.A.'s office was supposed to be defending my kids, and it looks like they won't."

However, under the plea arrangement, prosecutors dismissed all other traffic violations against him, including driving while impaired and driving on the wrong side of the highway. Sanchez was also given credit for the 10 months he has already served while awaiting trial.

DENHAM SPRINGS, LA (WAFB) - The man wanted for questioning after allegedly running away from the scene of an accident in which a 20-year-old motorcyclist died has been found, but his family worries bureaucratic red tape may prevent them from seeking justice for their lost loved one.

Louisiana State Police said they located Jesus Chacon, 45, in his native Mexico. Chacon is believed to be the man who was driving the truck that slammed head on into Blake Zieto on Nov. 18, 2006.

Zieto was riding his motorcycle down LA 16 in Denham Springs when the crash happened. The driver of the truck left the scene and Zieto to die. Four years later, the victim's family is learning more about that driver.

The Louisiana State Police had been looking for Chacon since that night, with federal agencies getting involved in the search. However, since Chacon was discovered to be living south of the border once again, Zieto's relatives worry he will get off scot-free.
"When he was killed, he died," said Judy Zieto, Blake's mother. "Our life ended."

Zieto described the last four years as a nightmare. She and her family are surrounded by love and a mountain of memories. However, there is one image in her mind that has stuck and while it has been four years, she just cannot erase it.

"Blake was under the motorcycle. The truck was on top of him. The truck caught fire. Blake was trapped," she explained.

Witnesses said Chacon ran off when his truck caught fire. Zieto died on the way to the hospital. His injuries were so traumatic his relatives were not allowed to look into his eyes one last time.

"So, I had to tell him goodbye to a covered face and chest and I got to say goodbye to his hand," his mother recalled.

Since then, she has made it her mission in life to stay on Chacon's trail. This year authorities informed the Zietos the suspect and his family were back in their native Mexico.

"They're with their children. They're celebrating the holidays. My baby turned 20 and we celebrated his birthday at the cemetery. I haven't put up a Christmas tree since he died. He loved decorating and I can't do it. It's too hard," Zieto added.

She may have given up on holiday parties and other events too painful to bear, but she is far from breaking a vow she made to her son as she took his hand one last time.
"I promised him I would do whatever I could to find Jesus and have justice brought and I'm not giving up until I do," she said.

At this point, authorities say their hands are tied. They must now issue a provisional arrest warrant through the Mexican government, which will then decide whether to send Chacon back to the U.S. to be prosecuted.

Cheryl, 47, Ian, 15, and Julianna, 7, were killed. Gary Ceran, Cheryl’s husband, Caleb, 12, and Clarissa, 19, were seriously injured but survived.

The family was on their way home from some last-minute Christmas shopping at Wal-Mart, after watching Gary, Clarissa and Caleb perform in "The Christmas Carol" at the Hale Centre Theatre in West Valley.

Prosecutors said Prieto, 25, had a blood-alcohol level of 0.19, more than twice the legal limit, when his pickup truck broadsided the Ceran family's car just after midnight Dec. 24.

A spokesperson for Immigration and Customs Enforcement interviewed Prieto and confirmed he is a Mexican national and is in the country illegally for several years.

A check of court records didn't bring up any previous arrests, but KSL News learned that two years ago Prieto was cited for speeding and driving without a license. That case was resolved in Salt Lake County Justice Court, after he paid a fine.

Prieto pleaded guilty to three counts of automobile homicide. Prosecutors dismissed three counts of driving under the influence of alcohol and one count of driving without a license as part of a plea bargain. He was sentenced for only two of the auto homicide convictions, for which he will serve up to 10 years in prison. He will serve up to five years for each count; one of them will run concurrently.

The crash wasn't the first time Ceran's family had experienced loss. Three other children, ranging from 3 weeks old to 14 months, died from tumors on their brain stem. Twins born prematurely also died within a day of their birth.

On February 6, 2007, a red Jeep Cherokee, going an estimated 75 – 100 mph in a 35 mph zone, was attempting to turn when it crossed the center line, careened of another vehicle and hit Leanna Newman's Saturn head-on in Landis, North Carolina. Newman, 20, of Salisbury, NC was eight months pregnant. Both she and her unborn child died the following day. Her one year old daughter, in a car-seat, survived the crash.

Police identified the driver that casued the crash as Rigo Verto Guillen Martinez. However federal authorities soon confirmed that his real name is Carlos Alfonso Guillen Martinez, and he is an illegal alien from

Martinez had a Mexican driver’s license, no state license, and a blood alcohol level of 0.27, which was more that three times the legal .08 limit. A paramedic said Tuesday that Martinez admitted after the crash that he'd had 20 beers.

Martinez was convicted of 2nd degree murder, drunk driving, and hit and run and was sentenced to 25 years in prison.

Members of Newman’s family and even one juror broke down in tears as the verdicts were read.
"When they came back with what they did, I said, ‘Thank you, Lord, thank you,’" Newman’s grandmother, Rena Fox, told Eyewitness News.

Some gasps and sighs of relief were also heard in the courtroom. The young woman’s family said they finally have the justice they’ve been waiting for. "We were nervous. We weren't sure it was going to come back our way, but when we heard, we all just hollered; we knew he was going to get justice,” said Newman’s mother, Bobbie Easley.

Martinez has been convicted twice previously of driving while impaired, three times of driving with a revoked license and assault charges. He's used at least half a dozen aliases and has already been deported from the U.S. twice.

Richard Rocha, an Immigration and Customs Enforcement spokesman, said that Martinez is from El Salvador and was deported in 1997 and 1998.

Carlyle Sherrill, Martinez's attorney, told the court his client came from El Salvador and had lived in the United States since he was 18. Martinez is a painter by trade and has been in the Carolinas for eight years, Sherrill said.

Leaana Newman is survived by her husband Brad and daughter.

Amanda Bixby, 19, was killed on Valentine's Day after another driver -_- who was speeding and didn't have a license -_- ran a stop sign and smashed into her vehicle near Basehor. 

On Wednesday, that other driver -_- Ricardo Flores an illegal alien-_- was given six months of probation and a $170 fine. Prosecutors say they couldn't seek a case of vehicular homicide because, under Kansas law, Flores' violations weren't enough to justify it. Flores' attorney said that probation was appropriate because this was purely an accident. Bixby's dad isn't satisfied. He said he's going to lobby the legislature to make the law stricter.

On Sunday, March 4, 2007, Dwane Braswell, 35, and his 9-year-old son, Jerry, of Clayton, NC were driving in a big rig when a car ran a stop sign and darted out in front of them. Braswell swerved to avoid it, but his cab rolled over and burst into flames, killing the father and son.

The two victims were burned beyond recognition in the fiery crash.

The driver that caused the Johnston County, NC accident, illegal alien Luciano Tellez, fled on foot but was subsequently arrested and placed in the Johnston County Jail. Two passengers in the car remained at the scene and told authorities what happened. The two passengers suffered minor injuries but weren't taken to a hospital, authorities said.

Some nearby residents said they thought the truck driver swerved in an effort to avoid direct impact.

"In this case, it seems that he sacrificed his own life to try to save somebody in that car that he didn't even know," said Shaw Fish, who lives near the crash scene.

Luciano Tellez, 31, of Angier, who is also known as Tellez Diaz, was charged with two counts of misdemeanor death by vehicle, felony hit-and-run, running a stop sign and driving with a suspended license.

Tellez, 31, had twice been convicted of drunken driving in North Carolina, in 2002 in Wake County and 2005 in Raleigh. In addition, Wake County officials had issued a warrant for his arrest for a probation violation stemming from his 2005 DWI conviction. Authorities said as a result of his conviction for drunken driving in 2005 he had a suspended license.
Alcohol was considered to be a factor in he crash, although Tellez was not charged with DWI, due to his fleeing the scenes of the wreck.

Sgt. M.J. Rivenbark of the N.C. Highway Patrol said many motorists are arrested for DWI after they have already lost their license.

"It happens more often than people really realize," he said. "Of course if they have tougher laws it would deter some of it, but it's still not going to keep people from driving."

U.S. Immigration and Customs Enforcement placed a detainer on Tellez after it learned he was in the country illegally, said Tom O'Connell, resident agent-in-charge of the federal agency's Cary office. Despite the prior convictions, Tellez had not come to ICE's attention. Had immigration officials known of Tellez's previous legal troubles, it may not have been enough to have him deported, O'Connell said.

Raleigh police weren't required to inform immigration officials of Tellez' prior arrest because he was charged only with a misdemeanor and had a valid driver's license, said Jim Sughrue, spokesman for the Raleigh Police Department.

Braswell is survived by his wife and a 12-year-old daughter.

Having a repeat DWI, illegal alien offender has some questioning why he was allowed back on the streets.

One lawmaker wants to make sure all county jails are screening inmates for their immigration status, a job that is usually the responsibility of the federal government. "We need to have a way to identify a person in jail if he's legal or not, that's just obvious," said Harris Blake of Pinehurst.

A family member of the victims wants people to remember a father and his son. The crash is highlighting a touchy debate about illegal immigrants, the jails and what local law enforcement should be doing about it.

Tessa Tranchant, 16, and Allison Kunhardt, 17, were killed in Virginia Beach, VA on March 30, 2007 when a car driven by drunk driving illegal alien Alfredo Ramos, plowed into the rear of their vehicle as they waited for a green light at an intersection.  Although girls were wearing seat belts, one died at the scene and the other at the hospital after having to be cut out of the car.  Ramos had previously been convicted, twice, on DUIs.

Ramos’ brother, who lives in Norfolk, also is here illegally and asked not to be identified because of his immigration status, said he talked to his brother by phone Friday before the accident and, after learning he had been drinking, warned Ramos not to drive.  Afterward, his brother told him he had no memory of the crash. He learned from authorities that he had killed two people, his brother said.

Ramos, who was born in Mexico of Guatemalan parents, has been in the United States for about seven years.  Most recently, Ramos was employed as a waiter at Mi Casita, a popular Mexican restaurant on Bonney Road in Virginia Beach.

Alfredo Ramos, was charged with two counts of aggravated involuntary manslaughter.

The girls were driving to a friend's house Friday night.  "I'm just going to go ahead and ride with denial for a while," Dylan Tranchant said.  Friends recalled Tessa as a goofy, sassy, positive girl to whom people could tell secrets in confidence and not worry about them becoming gossip.   "She wouldn't give anyone a reason not to like her," Samantha Augone said.

On 8-13-07, Ramos pleaded guilty to involuntary manslaughter.  Ramos  and faces up to 40 years in prison and deportation after serving the time.

The lives of two young friends, Alison Kunhardt and Tessa Tranchant, ended on March 30th, 2007, in Virginia Beach, Virginia. They were killed by Alfredo Ramos, an illegal alien.
 
On Friday night, Alison and Tessa were on their way to a friend's house. Their car was stopped at at redlight when Ramos, intoxicated and driving at least 65 mph, slammed in the back of their Plymouth Duster. Pinned in the wreckage, the girls had to be cut free before they could be treated for their injuries. Both wore seat belts. On girl died at the scene and the other was pronounced dead at the hospital.

Alison’s mother recalled “holding her daughter for the first time at Sentara Virginia Beach Hospital and for the last, at the same hospital”. (2) Tessa’s father considered suicide in July, 2007. (3)  

The girls were inseparable, often finishing each other's sentences. Alison's father, David, described her as having a "great sense of humor" and "always upbeat" with a love for music and theatre. He said, "Her number one thing, however, was to hang out with Tessa".

Tessa was remembered by friends as "googy, sassy and positive" and was liked by everyone. Her mother, Collette, shared that Tessa was an "aspiring chef" who "loved to sing and surf".

David Laird, a deputy prosecutor, described Ramos” in a stupor, he (Laird) likened to driving in the dark with sunglasses”. (2) Ramos pleaded guilty to two counts of aggravated involuntary manslaughter and was sentenced to 24 years in prison with deportation to follow. (3)

Ramos had previously been convicted in Virginia Beach of public drunkenness in 2006, and of identity theft, public drunkenness, and a DUI in Chesapeake, in 2007.  The arresting officer said “Ramos almost ran him down”. He was driving with a fake driver’s license and a blood alcohol level twice the legal limit. Officials in Chesapeake did not inform ICE of his immigration status.

24-year-old Never Navarro Montoya was driving a friend's pick-up truck without a license early Saturday when his vehicle collided with an SUV on University Blvd.

Charging documents said he was carrying a fake Social Security card and a green card purchased in Texas.

The accident killed a passenger in the SUV, 20-year-old University of Maryland sophmore Matthew Watson of Ellicott City.

Navarro-Motoya fled the scene and was later found a short distance from the crash.

He was charged with DUI, leaving the scene of an accident and possession of false gov't identification.

Crime Description:

On August 12, 2007 illegal alien Eddie Carbajal-Lile caused a traffic accident that resulted in the death of Paul Watry. The accident occurred Tuesday night in the town of Lima, WI.

Scot Mueller, 18, of Port Washington, WI, who was driving the car Watry rode in, said the impact of the crash knocked out Watry and rear-seat passenger Jillian Fitzmaurice. Both were on the right side of the vehicle, where Carbajal-Lile's car hit them. Fitzmaurice, 18, of Oostburg, WI, said she remembers waking up in the hospital, but recalls little of the crash. "I just remember seeing headlights," she testified at the trial.

Mueller suffered a broken left clavicle, left wrist and left hand, and Fitzmaurice suffered a broken jaw and ribs as well as numerous cuts to her face and a loss of hearing in one ear, they testified.

Watry of Port Washington died two days after the crash at Froedtert Memorial Lutheran Hospital in Wauwatosa as a result of injuries suffered in the crash.

Witnesses told investigators that the car Carbajal-Lile was driving failed to stop for a stop sign. After the collision, Carbajal-Lile fled on foot, witnesses said.

Capt. David Adams said Carbajal-Lile is an undocumented alien who might be en route to Mexico. The U.S. Border Patrol has been alerted, Adams said.

Carbajal-Lile reportedly uses a number of aliases, including: Eddie Carbajal; Eddie Lile; Eddie Carbajal-Farvies; Negro Carbajal; Negro Carbajal-Lile and Negro Lile.

The Sheboygan County District Attorney's office Thursday charged Carbahal-Lile with three felonies: hit and run, fatality; and two counts of hit and run, injury.

Carbajal-Lile has previously been convicted of driving without a license and DUI. Carbajal-Lile faces up to 23 years in prison if convicted on charges against him.

A few days after the accident, Carbajal-Lile and a friend were pulled over in a bar parking lot in Mt. Orab, Ohio, a small village about 25 miles east of Cincinnati. The friend had just made a harassing phone call to a bartender and was coming to talk to the bartender in person when the car — driven by Carbajal-Lile — was pulled over by an officer investigating the phone call. Both Carbajal-Lile and the friend were arrested on a charge of menacing, similar to disorderly conduct. Carbajal-Lile gave police a fake name, but he was identified through fingerprints and handed over to U.S. Immigration and Customs Enforcement.

Gabriel Anzures, a coworker of Carbajal-Lile's, told police he had been drinking with Carbajal-Lile and several other friends at a tavern about two miles from the crash site, and that he had seen Carbajal-Lile drink at least five or six beers in the three hours before the crash, according to the complaint.

Anzures testified that Carbajal-Lile called him twice after the crash. The two had left the bar between 8 and 8:30 p.m. that night "Eddie say, 'hey, I hit something.' He never told me what he hit, and the phone call died on me," Anzures said.

Kelynn Byrd


Kelynn Byrd, an innocent two year old child, died from being kicked repeatedly in the chest allegedly by Michael Hernandez, an illegal alien,  Kelynn died of blunt chest and abdominal trauma on August 12, 2007, in Coweta, Oklahoma.

Hernandez allegedly confessed to kicking Kelynn. (1) Kelynn’s mother left the apartment after a fight with Hernandez, leaving Kelynn alone in his care. When she came home it was obvious something was wrong with her baby. She called 911 and Kelynn was taken to a Tulsa hospital where the toddler died. (2)

“Whatever kind of anger that can lead up to someone doing that to a 2-and-a-half-year-old boy is just beyond me”, the toddler’s grandmother, Michelle Ebel said.  Burying her grandson was the hardest thing she ever had to do said Ebel.(3)  

Michael Hernandez was ordered to be held in the Wagoner County Jail without bond.  He was charged with first degree murder in the kicking death of Kelynn Byrd. (1)

Holly Megan Rogers, killed 11/11/07 in Tuscaloosa, Al. Victim of illegal immigrant, Emilio Mendez Hernandez, who had no license, insurance, and two prior DUI"S. At time of Hollys death his BAC was o.28, which led to A Change of Murder.

In April 2010, he pled guilty to MURDER. Sentencing was July 12, 2010. He was sentenced to 5 years, with time served then to be deported. He was sent to a state prison a month later and shortly after without serving anymore time, was deported back to Mexico.

Our government will pay for illegal immigrant to live here, but don't want to pay to keep them in Prisons once they have MURDERED our citizens.

Joshua George

Crime Description:

In the early morning hours of May 18, 2008, a drunk driver ran a red light and struck the side of seventeen year old Joshua George’s Toyota pickup.  Josh was ejected through a window of his truck. Josh had taken his girlfriend and two classmates home after their high school prom in Bluffton, South Carolina. Josh’s killer fled without stopping or calling for emergency assistance. 

Juan Olague Roman, a.k.a. Juan Rodriquez, an illegal alien was charged with felony drunk driving and leaving the scene of an accident great bodily injuries.  (1) 

Airlifted to Memorial Health University Medical Center in Savannah, Georgia, surgeons attempted to alleviate the pressure on Josh’s brain. Students held a vigil at Bluffton High. After two days, Josh had no brain activity and his family made the difficult decision to remove him from life support. Joshua’s family donated his organs. 

Cindy Sprouse, a former teacher and friend, speaking to 2,500 people gathered at the high school to celebrate Josh’s life, told the crowd Josh’s heart had saved the life of another.  "That very lucky someone got a very large heart," she said. "I've gotten to know so many wonderful young people in all the years I've been teaching. But none with the heart Josh has given to some lucky soul." (2)  

The death of Joshua George was very difficult for the community. Josh had touched so many with his “sense of humor, his love of life, and his devotion to his family”.  (2)  

Josh’s father, Major Aaron George, died when his F-16 crashed near Edwards Air Force Base in California seven years prior. Joshua was buried next to his father in Huntington, West Virginia.

Crime Description:

On the morning of May 24, 2008, five year old Frank Brooks, nicknamed 'Frankie Blue Eyes', died in his mother’s arms in the front yard of their rural Tate County, Mississippi home. Frankie was struck by a speeding drunk driver, illegal immigrant Jaime Perez.  While retrieving his sister’s shoe from beside the road, the little boy was run over as his brother and sister watched.  

Perez fled from the scene of the accident without hesitating and veered off of the road in his attempt to escape. (1) 

Frank’s mom, Frankie, held her little boy as he died. “He had blood coming out his ears. Eyes still open. He didn’t have time to blink or hurt…and…it was over, like, that fast,” she recounted in an interview. (2) 

Family members described Frankie as “an angel”, “loving” and “full of energy”. (1)  Ironically, Frankie’s mother moved her family from Memphis, Tennessee, to rural Mississippi to get them away from the “crime of the big city”. 

When asked how she is coping, Frankie Brooks replied, "Truthfully, I basically have no will to live anymore; I am just going through the motions dealing with work and trying to be strong for my family. I only see an unhappy life for the rest of my life." (3) 

Perez was charged with DUI, leaving the scene of an accident and driving without a license. He had a Tennessee identification card, Mexican ID’s and “questionable” Social Security cards. (1)

Matthew Bologna annd Michael Bologna


Crime Description:

“I want the people to see…my family wasn’t safe, what makes you think yours will be?”  Through profound sorrow and with remarkable courage, Danielle Bologna spoke about the shooting deaths of her husband, Anthony, and her two sons, Michael and Matthew in San Francisco, California, on June 22, 2008. (1) They were allegedly assassinated by Edwin Ramos, illegal alien and violent MS-13 gang member.  

Anthony Bologna, 48 years old, and his sons Michael, 20, and Matthew, 16, were driving home from a family barbecue. Forced to stop, they temporarily blocked another car from completing a left turn. Mr. Bologna backed up to allow the turn amidst the angry stares of the driver.  Allegedly Ramos opened fire, killing Anthony and Michael. Matthew died on Tuesday at the hospital. Danielle had him removed from life support, “It was the most difficult part of my entire life to look at my baby and know he was gone …” (2) Danielle is unable to face returning to the cold, empty silence of home.
Described by his brother-in-law, Frank Kennedy, Anthony was “a wonderful individual and great father”. (2) Anthony worked nights as grocery store supervisor and coached youth basketball and baseball at St. Philip the Apostle Catholic School. 

Michael, an outstanding athlete, loved to play basketball and was attending City College of San Francisco. Matthew was going to be a high school junior. He was described as having “a heart filled with kindness for his family and all those he touched”. (3)   

As a juvenile, El Salvadoran native Ramos was convicted of gang-related assault and the attempted robbery of a pregnant woman. Protected by San Francisco’s sanctuary city policy, he was never reported to federal immigration authorities. Arrested on a gun charge in March, federal officials inexplicably did not place an immigration hold on Ramos after learning he was an illegal alien. (2)  
Ramos pleaded “not guilty” to three charges of murder with the special circumstances of multiple victims and murder as part of a street gang, each carrying life in prison without parole or the death penalty.

Mayor Gavin Newsom, who used to have at least a couple of press appearances every day, has been curiously absent of late. But we finally caught up with him at a City Hall flag raising today to mark the anniversary of independence for Guatemala, El Salvador, Nicaragua and Mexico. (It wasn’t on his public calendar for the day, but pretty much nothing is anymore.)

Anyway, we at long last got to ask him about District Attorney Kamala Harris’ controversial decision last week to not seek the death penalty in the trial of Edwin Ramos, the alleged killer of Tony Bologna, 48, and his sons, Michael, 20, and Matthew, 16.

You’ll recall Ramos, an illegal immigrant, was never turned over to federal authorities after being picked up on other charges as a teenager. That policy has since been reversed by Newsom – and now undocumented youth are turned over when they’re arrested for felonies – but the issue is expected to be a big one in the mayor’s campaign for governor.

Anyway, Newsom is backing Harris’ decision.

“I can sit here on the sidelines and provide punditry, but none of us are privy to the facts of the case so I defer to her judgment,” he said.

Asked whether he expects the Ramos case – and the fact San Francisco isn’t seeking the death penalty – to be problematic for him on the campaign trail, he said, “I don’t look at issues like this as campaign issues. This is about human beings, about real people. It’s not about politics.”

Crime Description:

On September 4, 2008, in Aurora, Colorado, little 3-year old Marten Kudlis was sitting at a table by the window in Baskin-Robbins waiting for his mom to bring him and his buddy ice cream.  Patricia Guntharp, a mother of three, and her friend, Debra Serecky, a mother of six, were turning into the parking lot in a Mazda pickup truck driven by Patricia. 

Behind the wheel of a GM Suburban, illegal alien Francis Hernandez, 23, ran a stop light at more than 80 mph, over twice the posted speed limit. The large SUV struck the pickup and forced both vehicles through the front of the Baskin-Robbins ice cream store.

An injured witness compared the impact of the vehicles to a “bomb going off.”  Three year old Marten was caught on a jagged piece of metal debris which made a large gash in his neck causing him to quickly bleed to death. The two women in the pickup were killed instantly by the impact.  Additionally, in the ice cream shop, Haley Tepe, Margaret Raines, and Nimra Bulhari, 10, were injured. 

Duane Stokes, an ex-firefighter, heard the accident and came running to the scene where he tried to save the little boy.  After a short time, Marten squeezed his hand and then drew his last breath, “I just want the community to know...parents to know, he didn’t die alone,” Stokes said.

Police say Hernandez ran away from the scene of the carnage he had just caused but he was arrested a short time later and charged with:

3 counts of vehicular homicide
3 counts of hit & run
Single counts of reckless driving and vehicular assault
No valid operators license
No proof of insurance

During the investigation it was discovered that Francis Hernandez was an illegal alien from Guatemala and that he had 19 prior arrests, mostly in the city and county of Denver.  Authorities said Hernandez avoided deportation by using 12 aliases and two dates of birth to slip under the radar of immigration officials.

Marten’s father, Eddy Kudlis and his younger brother emigrated to the U.S. in 1981 with their mother from Belarus, a former Soviet state between Poland and Russia.  The family lived in Brooklyn for 25 years before coming to Colorado. Their mother died in July 2007 of cancer, followed by their stepfather a few months later.  Little Marten is now in the Fairmount Cemetery.

Jurors found Francis Hernandez guilty of vehicular homicide and other charges.  He was sentenced to 48 years in prison.

WAUSAU (WAOW)--It's a case that's been dominating headlines across our area...the trial of Raul Ponce-Rocha who is accused of murdering 18-year-old Breanna Schneller. Here's a recap of what has happened in the trial so far.

The judge and jury have heard from 15 witnesses in three days of testimony.

 Prosecutors are focusing in on key pieces of evidence and information to try and convict Raul Ponce-Rocha of murdering Breanna Schneller.

 On day one, the trial took an emotional turn when testimony was heard from Hugo Ramirez, the brother of Schneller's former fiance Sebastian Ramirez. He shared an apartment with the two and was the one who discovered Schneller's body at the apartment in May of 2009.

During his testimony, Ramirez said he found Schneller in the apartment and  "was yelling out her name and banging on the door...trying to get a response from her and hoping she was still alive."
 A state crime lab agent also weighed in on the case Wednesday, giving jurors some insight into the severity of Schneller's fatal wounds.

 Day two saw more grueling testimony, including the forensic pathologist who performed Schneller's autopsy. He told the court the stab wounds on her body were innumerable. He also described how the cuts to Schneller's chest were curved and scalloped, leading him to believe they were inflicted by a broken knife.

"If we look at the wounds to the chest you will see that the edges are very irregular, they're not linear, they're scalloped and do not follow a straight line," said Dr. Robert Corliss.

 Schneller's mother had to leave the court room after hearing descriptions of her daughter's attack.
Jurors also heard from Ponce-Rocha himself when prosecutors played an interview conducted just four days after Schneller was found dead.

 On Friday, detectives detailed evidence that could directly link Ponce-Rocha to Breanna Schneller and the crime scene. Hairs found on a brown sweatshirt Ponce-Rocha was seen wearing the day of Schneller's death have been sent to the crime lab for DNA testing.

Surveillance video from El Tequila Salsa where Ponce-Rocha worked was also used to build the case against him.

Detective Cord Buckner stated in his testimony that there were inconsistencies in the time Ponce-Rocha told detectives he was away from working picking up a co-worker.

 When the trial resumes Monday, DNA experts are slated to take the stand.

Traven Keigley, 16, was killed in NC. Driver of the other car had no license. According to Mecklenburg County records, Jose Santos Tobias has been charged before with NO license.


State Highway Patrol confirms one person was killed Wednesday in a multi-vehicle wreck on Interstate 40.

Troopers say a red 2004 Pontiac traveling north on I-85 spun out of control and hit a white 2007 Nissan.  The Nissan hit another vehicle, went over the guard rail and down an embankment. One person in that car was pronounced dead at the scene.  

Troopers say 16-year-old Traven Keigley, from Ohio, was killed after being partially ejected from the vehicle. Authorities say Keigley was a backseat passenger and was not wearing his seat belt.

Four others in the Nissan were taken to UNC hospital with injuries.  Authorities did not provide information on the extent of the injuries.

The driver of the Pontiac, Jose Santos Tobias, of Charlotte, has been charged with misdemeanor death by motor vehicle and no operators license.

Two lanes of I-40 east near the I-85 split were closed while crews cleaned up the scene.

A driver traveling the wrong way on a Nash County highway died early Tuesday when, the North Carolina State Highway Patrol said, his vehicle collided with a car carrying three teenage girls, killing one and injuring the other two.

Authorities said they believe both drivers had been drinking.

The wreck happened around 2 a.m. on U.S. Highway 64 near Frazier Road, about 4 miles southwest of Spring Hope.

A 34-year-old man was driving a 1989 Honda westward in the eastbound lanes when he hit a 2000 Chevrolet carrying three 17-year-old girls, Highway Patrol Sgt. David Wainwright said.

The man's name was not released, pending notification of his family. Beer cans could be seen on the floor of his wrecked car, along with a malt beverage behind the steering wheel.

Multiple motorists called 911 reporting the vehicle traveling in the wrong direction, including a woman who followed from the other side of the highway in the eastbound lane.

Troopers released the name of the driver who was traveling in the wrong lane of U.S. 64 and crashed head on into another car carrying three 17-year-olds.

Troopers say 34-year-old Germain Gomez was driving westbound in the eastbound lanes of Highway 64 near Spring Hope around 2 AM Tuesday. They say he slammed into http://www.blogger.com/post-create.g?blogID=8201742889910597043another vehicle head-on, killing Brianna McLaughlin from Rocky Mount.

According to Troopers, Gomez had empty beer cans in the car and prescription drugs were also found with him. They say neither drug should have been used with alcohol.

Troopers say the medicine could cause dizziness and drowsiness - and he should not have used heavy machinery, such as a vehicle.

Gomez was staying with his mother in Raleigh but had a Virginia address. Troopers say Gomez had been a legal resident of the U.S. since 1995.  (Not a citizen - why wasn't he deported?)

Virginia court records show the 34-year-old Gomez had numerous convictions, including two for speeding, two others for being drunk in public and another for driving on a revoked license. No record of any charges for him were found in North Carolina.

The Highway Patrol says alcohol was a factor for both drivers. The other driver, Paige Toelke of Nashville, remains at WakeMed in serious condition. Troopers say it could be several days or even weeks before they know about charges in the case because they have yet to talk to the two girls who survived the crash.
